Am I entitled to make a claim?
If the accident was not your fault or you are only partly to blame then you should be able to make a claim. Passengers in vehicle collisions are almost never at fault for causing an accident except when they have distracted the driver.
If both drivers are partly to blame for causing an accident then liability is divided between them on a percentage basis entitling both to claim compensation against each other.
Is there a time limit on starting my claim?
Claims must be settled or legal proceeding must have been issued in a court of law within three years from the date of the accident subject to certain exceptions. If you were under eighteen at the time of the accident then you have three years from the date of your eighteenth birthday. There are other exceptions and advice should always be obtained from a qualified solicitor as soon as possible after the accident.

Is there anything I should I do after an accident?
- Visit the A&E department of your local hospital and make an appointment to see your GP to make a record any injuries.
- You should take photographs of any visible injury at intervals during the healing process.
- Make a note of the registration number, make and model of all the vehicles involved.
- Obtain the address and telephone number of others involved in the accident.
- Obtain details of the insurance policies of all the parties involved.
- If the police are involved obtain the officers name and number.
- Obtain witnesses names, addresses and telephone numbers.
- Record the date and time of the accident, the street and city and weather and road conditions.
- Draw a diagram of the vehicles, people and property immediately before and after the accident, and take photographs of any damage and the road layout which may change over time.
